A residency route based on your marriage

Residency through marriage in Costa Rica is a temporary category for foreign spouses of Costa Rican citizens. You must document the registered marriage and the genuine marital relationship. Getting married does not automatically grant immigration status.

A Costa Rican spouse

Your spouse’s Costa Rican citizenship and identification must be established in the required records.

A registered marriage

The marriage must appear in Costa Rica’s Civil Registry. A marriage abroad requires the applicable registration process.

A genuine relationship

Immigration assesses the marital relationship. Evidence and interview preparation are important parts of the application.

This route is based on marriage rather than a Pensionado, Rentista, or Investor financial threshold. Application expenses and post-approval obligations still apply.

Start with your marriage records

If you married in Costa Rica

We review the Civil Registry marriage certification and the spouses’ identification records before preparing the immigration application.

If you married abroad

Your foreign marriage must be registered in Costa Rica. Registration is a separate process from the residency application and can require authenticated documents and translations. Your proposal should specify whether that work is included.

Prepare for the Immigration interview

The service page identifies an interview with Immigration in San José as part of the process. We help you understand the required evidence and appointment arrangements. Confirm the current procedure when your file is prepared.

What documents will you need?

Confirm your personal checklist before ordering documents. Marriage registration, your nationality, residence history, and filing date determine the evidence and timing needed.

Marriage and local evidence

  • Marriage certification issued by Costa Rica’s Civil Registry.
  • Required identification evidence for your Costa Rican spouse.
  • Supporting evidence of the genuine marital relationship.
  • Foreign marriage registration documents when applicable.
  • Interview coordination and additional evidence requested by Immigration.

Your application documents

  • Passport and required copies.
  • Birth certificate and required criminal background certificate.
  • Application form and supporting letter.
  • Photographs and applicable government payment receipts.
  • Fingerprint registration and consular registration where applicable.
  • Appropriate authentication and accepted Spanish translations of foreign documents.

Our apostille guide and background check guide explain the foreign-document steps. Coordinate document validity with the intended filing date.

Plan your application budget

Ask for a written proposal identifying each applicant, the legal work included, payment options, and separate expenses. There is no need to mix government charges with the legal service fee.

Legal service fee: US$750

The published fee for the main applicant is payable in three installments:

  • US$250 retainer to begin.
  • US$250 when the application is filed.
  • US$250 when residency is approved.

Your written proposal confirms the services included and any fees for additional applicants.

Government payments

  • Application: US$250.
  • DIMEX identity card: US$128.
  • Security deposit: budget from US$300, subject to the amount applicable to your passport nationality and case.

These are the planning figures published on our service page. Confirm the applicable payments and exemptions in your written estimate.

Document expenses

The published estimate allows US$150 for translations and US$100 for certifications. Translation pricing is US$25 per page; the actual total depends on the documents and number of pages.

Budget separately for foreign certificates, background checks, apostilles, shipping, applicable CAJA contributions, and future renewals. These estimates are not an all-inclusive quote.

How we help you move forward

01 / REVIEW

Confirm the registered marriage

We review your marriage records and identify any registration issues before preparing the residency application.

02 / PREPARE & FILE

Coordinate your documents

We help prepare the required evidence and submit the application to DGME through the appropriate channel.

03 / FOLLOW THROUGH

Complete approval requirements

We follow up on the file and coordinate applicable CAJA, payments, and DIMEX steps after approval.

The service page publishes a planning estimate of 6–12 months for application processing, depending on case volume and the completeness of the file. Document procurement comes before filing and adds its own time.

After approval, complete applicable CAJA enrollment, remaining payments, and the DIMEX appointment. The original process graphic estimates 2–3 weeks for card delivery; confirm current availability and delivery arrangements when scheduling. These are published estimates, not guaranteed deadlines.

Questions about marriage residency

Does marriage automatically grant residency?

No. You must apply to Immigration and satisfy the category’s requirements. A marriage certificate alone is not a residency approval.

Is residency through marriage temporary or permanent?

This is a temporary residency route. After three consecutive years, eligible applicants can request permanent residency through a separate application. Renewals require compliance with the applicable marriage-based conditions.

What if we married outside Costa Rica?

The marriage must be registered in Costa Rica’s Civil Registry. That is a separate process from the immigration application. Confirm its documents, costs, and timing before filing.

Will we need an interview?

The current service page identifies an Immigration interview in San José. We help coordinate the required evidence and explain the appointment process. Confirm the current procedure for your application.

Can I work before my application is approved?

Marriage or filing an application does not by itself grant work authorization. Work rights must be confirmed against your approved immigration status and any required authorization before starting employment.

Do I need a pension or qualifying investment?

This category is based on a qualifying marriage rather than the financial thresholds of Pensionado, Rentista, or Investor residency. Government charges, document costs, and insurance obligations still apply.

How much is the legal service fee?

The published main-applicant fee is US$750, paid as US$250 to begin, US$250 on filing, and US$250 on approval. Government and third-party expenses are separate. Your written proposal confirms the work included and any additional registration services.

How long does the process take?

The published estimate is 6–12 months for application processing, excluding document procurement and any foreign marriage registration. The process graphic estimates 2–3 weeks for DIMEX delivery after the relevant registration steps. Confirm current timing; these are not guaranteed deadlines.

Is citizenship through marriage the same process?

No. Naturalization through marriage is separate from residency, with its own requirements. We can review the appropriate route for your circumstances without treating a residency application as a citizenship application.

What happens if our circumstances change?

Marriage-based renewals require evidence of the marital relationship. If you separate, divorce, or experience another material change, seek an individual review of your status and options before renewing.

Explore the legal framework

Articles 73 and 79 of Law 8764 address marriage-based residency. See DGME for Immigration information and our complete residency guide to compare routes. A legally recognized common-law union requires its own assessment; it should not be treated as an unregistered marriage.
